1. Acceptance of Terms
By downloading, accessing, or using the Handshake mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Handshake is a professional networking application that uses Bluetooth Low Energy (BLE) technology to facilitate contact exchange between users at events and conferences. The Service includes proximity detection, digital business card exchange, contact history, and in-app CRM features.
3. Eligibility
You must be at least 16 years old to use the Service. By using Handshake, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To use the Service, you must create an account using Google Sign-In. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your profile information is accurate and up to date
- Notifying us immediately of any unauthorized use of your account
5. Acceptable Use
You agree not to use the Service to:
- Harass, spam, or send unwanted communications to other users
- Impersonate another person or create a false identity
- Collect or harvest other users' information without their consent
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or attempt to extract the source code
- Use the Service for any illegal or unauthorized purpose
- Transmit malware, viruses, or other harmful code
- Scrape, mine, or automatically collect data from the Service
6. Bluetooth and Proximity Features
By enabling BLE features, you acknowledge that:
- Your device will broadcast a Handshake identifier to nearby users
- Other Handshake users may detect your presence at events
- Proximity data is recorded when both parties have the app active
- You can disable BLE detection at any time through the app settings
- Contact exchange requires explicit mutual consent from both parties
7. User Content
You retain ownership of all content you submit to the Service (profile information, notes, tags). By posting content, you grant Handshake a non-exclusive, worldwide license to use, display, and distribute your content solely for operating the Service.
You are responsible for ensuring your content does not violate any third-party rights or applicable laws.
8. Intellectual Property
The Service, including its design, features, code, and branding, is the property of Handshake and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Proximity detection accuracy depends on hardware capabilities and environmental factors.
11. Limitation of Liability
To the maximum extent permitted by law, Handshake shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, data loss, or business interruption.
12. Termination
We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via the app or email. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
